How does it work?
You are interacting with Artificial Intelligence
(AI):
Answers are generated by an open-source Large Language Model
(such as GPT OSS 20B). It serves strictly as an assistance
system for your workflows.
Results may be inaccurate: Information
generated by the AI can be inaccurate, incomplete, or outdated.
It is your mandatory responsibility to carefully check and
verify all results before use. No decisions may be made based on
these results without independent human review and approval.
Your data is securely handled internally: Your
data is processed and only stored on internal servers in
Nuremberg, Germany. To ensure maximum data privacy, all chat
histories, prompts, and uploaded files are automatically and
irrevocably deleted every weekend and no backups are created.
While this allows — in contrast to Gemini — usage of
client data and context, do not upload data that is explicitly
prohibited for AI use (such as high-criticality trade secrets or
VS-NfD).

Terms of Service (ToS)

§ 1 Scope and Purpose
These Terms of Service govern the internal use of the AI-powered
chat assistant based on AnythingLLM (hereinafter “the
Service”).
The Service is provided exclusively to authorized employees
(hereinafter “Users”) of the company for the purpose
of supporting professional tasks through text analysis,
summarization, and drafting.
§ 2 Handling of Confidential and Sensitive Data
Given the local hosting in Nuremberg and the lack of external
web-connectivity for core functions, the Service is approved for
processing internal, confidential, and sensitive business data.
The processing of data subject to official security clearances
(e.g., VS-NfD or higher) or data explicitly flagged as
“Not for AI Processing” remains strictly prohibited.
Users must ensure that the input of personal data of colleagues
or third parties is limited to the minimum extent necessary for
the specific professional task (data minimization).
§ 3 System Environment and Data Deletion
The Service operates on dedicated infrastructure in Germany. No
data is transmitted to external LLM providers (e.g., OpenAI).
To ensure maximum privacy, all session data (prompts, responses,
and uploaded files) is automatically and irrevocably deleted
every weekend.
Users are responsible for extracting and saving any
business-critical results into the company’s official
record-keeping systems (e.g., DMS, CRM) prior to the weekly
deletion. The Service does not provide a permanent archive.
§ 4 User Responsibilities
The Service is an assistance tool, not a factual source. Users
must verify all outputs for accuracy, completeness, and bias
before further use.
Access is granted via individual accounts. Users must keep their
credentials secure and are prohibited from sharing access with
unauthorized parties.
§ 5 Warranty and Liability
The Service is provided on an “as-is” and
“as-available” basis. The company does not guarantee
the accuracy, reliability, or uninterrupted availability of the
Service.
In accordance with German labor law principles (limitations of
employee liability), the User remains responsible for the work
products created using the Service. The company is not liable
for damages resulting from unverified AI-generated outputs.
Liability for intent (Vorsatz) or gross negligence (grobe
Fahrlässigkeit), as well as for damages to life, body, or
health, remains unaffected by these limitations.
§ 6 Term and Termination
The right to use the Service is tied to the User’s active
employment or project-based authorization.
Access may be revoked at any time by the company without prior
notice for technical, security, or organizational reasons.
Upon termination of the employment contract, the right to use
the Service ends automatically.
§ 7 Final Provisions
These terms are governed by the laws of the Federal Republic of
Germany.
Should any provision of these Terms of Service be or become
invalid or unenforceable, the validity of the remaining
provisions shall not be affected.
To the extent permitted by law, the place of jurisdiction for
all disputes arising from this Service is the company’s
headquarters.

2. Purpose and Legal Basis
The processing of personal data (Username, Log-data, and Chat
content) is conducted to enhance workplace efficiency and support
internal data analysis (Art. 6 (1) (b) GDPR and § 26 BDSG
(Employment context)). For the processing of confidential business
data, the legal basis is the legitimate interest of the company
(Art. 6 (1) (f) GDPR) in providing a secure, internal AI
environment.
3. Technical Infrastructure and Storage
The Service is hosted on dedicated servers by netways GmbH in
Nuremberg, Germany.
The Service is configured to operate without external web-access
for its Large Language Model (LLM) functionalities, ensuring
that no data is transmitted to third-party AI providers (e.g.,
OpenAI, Google).
Access to the database is technically restricted. While one
system administrator holds technical access for maintenance
purposes, any access to chat content is contractually strictly
forbidden and would constitute a breach of employment/service
contracts.
4. Retention and Deletion
To adhere to the principle of data minimization, a strict weekly
deletion policy is in place. All session data, including uploaded
documents and conversation logs, are wiped every weekend.
5. Data Subject Rights
Users have the right to access, rectify, or erase their personal
data. Due to the weekly deletion cycle, requests for access to
specific chat contents can only be fulfilled if submitted on the
same week the data was generated.
